POST JUDGMENT MODIFICATION and ENFORCEMENT
Post judgment modification and enforcement include matters such as forcing the sale of the home, refinancing a home, payment of debt, changing child support or changing spousal support.
Once the court has entered an order or judgment all parties are bound. Often times parties bound by a court order will agree to alter the terms. If this is the case, a new order must be entered. Under certain circumstances, prior court orders can be modified by motion of either party. If a party does not abide by a court order, the aggrieved party has the right to go back into court and request the assistance of the court in enforcing the order.
PARENTING TIME
Visitation, or what is now called parenting time, is a right afforded to any parent (unless the safety of the child is in question). If a custody order is in place, the non-custodial parent has the right to petition the court for specific parenting time.
PATERNITY ACTIONS
A paternity action is a case filed for the legal determination of the father of a child. The woman can file a complaint for paternity against the alleged father of her child or a man can file against a mother asserting he is the father of her child. The state can also file a case against the alleged father if the mother and child are receiving state aid. Genetic testing will be ordered by the court if the parties do not agree on the identity of the father.
CHILD SUPPORT
The parent of a child may petition the court for child support from the other parent if that parent is not contributing to the support of the minor. A custodial parent may receive child support for a child until the child reaches the age of 18 years or graduates from high school (whichever is later), but not beyond the age of 19 years and 6 months. Child support in Michigan is calculated pursuant to the Michigan Child Support Formula which uses the incomes of both parents. At MELLIN ROBINSON, P.C. we use the same program that the Friend of the Court uses to calculate child support, so as to inform our clients prior to a court hearing what child support is likely to be.
GUARDIANSHIPS
For various reasons, parents may need to set up guardianships for their children on a temporary or permanent basis. Third parties may also petition the court for guardianship of a minor child in some situations, such as when a child is left in the care of the petitioner or when one or both parents are absent and have failed to provide for the child. |
